French officials encounter roadblock as Elon Musk's X Corporation denies access to its algorithm
In a significant turn of events, Elon Musk's social media platform, X (formerly Twitter), is currently under investigation by French cybercrime authorities. The investigation, which commenced in early 2025, focuses on allegations of algorithmically manipulating content visibility and fraudulent data tampering.
The Paris prosecutor's office initiated the preliminary investigation following complaints, including one from centrist MP Eric Bothorel. The complaints point towards suspicions that X altered its content display algorithms to promote far-right themes and candidates, such as the German far-right party AfD, allegedly reflecting biases supported by Musk personally.
The investigation has since been assigned to the national gendarmerie, enabling search, seizure, and interviews to gather evidence. However, X has publicly denied the allegations, branding the probe as politically motivated and an attempt to restrict free speech. The company has rejected claims of any criminal wrongdoing regarding algorithm manipulation or data extraction.
The investigation involves a unique legal theory, suggesting that distorting a social media platform's recommendation algorithm can be punishable by the same penalties as computer hacking. Until now, Article 323-2 of the French penal code, which the investigation allegedly violates, has been used exclusively to punish data theft and other forms of computer piracy.
As of mid-July 2025, no formal charges have been publicly announced yet, with the probe remaining active. The case involves both X as a legal entity and unidentified individuals tied to its management. It is important to note that a study conducted by researchers at the Queensland University of Technology in Australia claimed to have found evidence of algorithmic bias in favor of right-wing content on X. However, this study's findings have not been independently verified or corroborated by other researchers or organizations.
In response to the investigation, X's Global Government Affairs page referred to it as a political witch hunt. Despite the ongoing investigation, X has publicly refused to cooperate with the authorities. The investigation was later transferred to a "key unit of France's national police."
